Affiliate Content Usage & Sample Terms
Grant of Rights & License
By participating in any Pacinos affiliate program, campaign, promotion, or by receiving any product samples from Pacinos (whether free, discounted, or provided for review), you hereby grant Pacinos a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, edit, create derivative works from, publish, distribute, publicly display, publicly perform, and otherwise exploit any content you create featuring Pacinos products.
This license includes, without limitation, use across all Pacinos-owned or controlled channels, including but not limited to websites, email, e-commerce platforms, social media, paid advertising, organic marketing, third-party platforms, and future media formats, whether now known or later developed (including Meta, TikTok, YouTube, paid ads, and retail assets).
Predated Content & Retroactive License
These Affiliate Content Usage & Sample Terms apply to all content created prior to the publication date of this document that features Pacinos products, provided such content was created by an individual who received product samples, commissions, rewards, or other consideration from Pacinos, or participated in any Pacinos affiliate, creator, or promotional program.
By continuing to participate in any Pacinos affiliate activity, retaining previously received products, or failing to request a return of unused samples within the applicable return window, you hereby ratify and confirm the license granted herein for all such pre-existing content under the same perpetual, irrevocable, worldwide, royalty-free, non-exclusive terms.
Derivative Works & Perpetual Use
Pacinos may edit, remix, crop, subtitle, dub, combine, or otherwise modify submitted content and may use such content in perpetuity, without additional approval, compensation, or notice beyond the rewards, commissions, or samples already provided.
Acceptance Through Conduct
Acceptance of these terms is automatic and binding upon any of the following actions:
- Receiving Pacinos product samples
- Using Pacinos products
- Creating, publishing, or submitting content featuring Pacinos products
- Participating in any Pacinos affiliate program or campaign
No additional written agreement or signature is required.
Opt-Out & Sample Return Policy
Affiliates who do not wish to grant these rights must not use the product, must not create or publish content, and must return all unused product samples.
Returned products must be:
- Unused
- Sealed
- In original shipping packaging
Return instructions must be requested within 5 business days of delivery. Failure to return products as required will constitute acceptance of these terms.
Standard Applicability
These terms apply globally and uniformly to:
- All Pacinos affiliates
- All creators receiving samples
- All content created using Pacinos products
- All current and future affiliate programs, whether campaign-based or not
These terms supersede any informal agreements or verbal representations regarding content usage.
No Additional Compensation
Unless explicitly stated in writing by Pacinos, no additional compensation, royalties, or licensing fees are owed for the use of affiliate-created content beyond agreed commissions, rewards, or product samples.
Acknowledgment
By receiving Pacinos products, participating as an affiliate, or creating content featuring Pacinos products, you acknowledge that you have read, understood, and agreed to these Affiliate Content Usage & Sample Terms in full.
